2. Collection and saving the personal data and nature and purpose of its use

When visiting the website

If you use the website www.geniatech.eu purely for information purposes, i.e. you do not register or send us any other information, the browser used on your device automatically sends information to our website server. This information is saved temporarily in what is known as a log file. The following information is recorded without you doing anything and saved until it is deleted automatically:

  • IP address of the querying computer,
  • Date and time of access,
  • Time zone difference to Greenwich Mean Time (GMT),
  • Name and URL file accessed,
  • Access status/HTTP status code,
  • Volume of data transferred,
  • Website from which you accessed our site (referrer URL),
  • Browser used,
  • Operating system on your computer and its interface,
  • Name of your access provider,
  • Browser software language and version.

This data is processed by us for the following purposes:

  • To guarantee a seamless connection is established to the website,
  • To guarantee user-friendly use of the website,
  • To evaluate system security and stability
  • and for other administrative purposes.

The legal basis for this data-processing is article 6, para. 1, clause 1, letter f, GDPR. The purposes of the data collection above are based on our justified interests. Under no circumstances will we use data collected to derive information about you.

When you visit our website, we also use cookies and analysis services. We make a distinction between cookies which are technically necessary and those which are for the purposes of statistical recording and optimisation. The latter are used only if you have consented to this. You can find more details about this in sections 4 and 5 of this privacy policy.

 

If you subscribe to our newsletter

If you have provided explicit consent in accordance with art. 6, para 1, clause 1, letter a GDPR, we use your email address to send you our newsletter on a regular basis. Entering an email address is sufficient to receive the newsletter. Entering further data marked as separate is voluntary, and this data is used to provide more targeted information.

You can unsubscribe at any time, for example, using the link at the end of every newsletter. Alternatively, you can send a request to unsubscribe by email at any time to datenschutz@eu-geniatech.com.

 

If you use our contact/support or complaint form

If you have any questions or support requests, or in the event of a complaint, we offer you the option of making contact with us through the forms provided on the website. This requires you to provide at least a valid e-mail address, so we know who the question comes from and we can respond. As a rule, further information can be provided on a voluntary basis. Further information is required for support requests and complaints.

Data processing for the purposes of making contact with us is in accordance with art. 6, para 1, clause 1, letter a GDPR on the basis of the consent you have provided voluntarily, or in accordance with art. 6, para 1, clause 1, letter b GDPR for support requests or complaints.

The personal data collected by us for the use of the relevant forms is automatically deleted once your enquiry has been resolved.

 

If you use our web shop

If you wish to place an order in our web shop, you need to provide personal data in order for us to process your order and conclude a contract. The mandatory information required to process the contracts is marked separately, further information is voluntary. We process the data provided by you in order to execute your order. To do this, we may forward your payment information to our company bank. The legal basis for this is article 6, para. 1, clause 1, letter b, GDPR.

You have the option of creating a customer account, which allows us to save your data for further purchases in the future. If you create an account under “My Account”, the data you provide is saved on a revocable basis. All further data, including your user account, can be deleted in the customer area at any time.

We can also process the data provided by you in order to inform you about other interesting products in our portfolio or send you emails with technical information.

Business and tax law regulations stipulate that we must save your address, payment and order data for a period of ten years. However, after two years, processing is restricted such that your data is only used in order to comply with the statutory regulations.

In order to prevent unauthorised access by third parties to your personal data, especially your financial data, the order process is encrypted using TLS technology.

If you use further functions and services on our website

As well as using our website for information only, and the newsletter and forms options, we offer various services which you can use if you are interested. To do this, you generally need to enter further personal data which we require and use to provide the relevant service.

Sometimes, we use external service providers to process your data. They have been carefully selected and commissioned by us, are bound by our instructions and are regularly checked.

We can also pass your personal data on to third parties where we are offering promotions, competitions, contracts or similar services in conjunction with partners. You can find more detailed information on this when you provide your personal data or in the small print at the bottom of the service description.

If our service provider or partner has their headquarters in a country outside the European Economic Area (EEA), we will inform you of the consequence of these circumstances in the description of the offer.

If you have provided consent to the processing of your data when using further functions and offers on our website, you can revoke this at any time. Once expressed to us, this revocation has an impact on our rights to process your personal data.

If our processing of your personal data for the use of further functions and offers on our website relies on weighing up interests, you can submit an objection to this processing. This applies especially if the processing is not required for the fulfilment of the contract with you, which we will always highlight in the following description of the functions. If you do revoke your consent in this way, we ask you to set out your reasons why we may not process your personal data in the ways we have described. If your objection is justified, we will check the situation and either discontinue or modify data processing or set out to you the binding proprietary reasons for which we are continuing with the processing.

3. Forwarding of data

Apart from the purposes listed below, your personal data will not be passed on to third parties.

We will only pass your personal data to third parties if:

  • You have given your explicit consent in accordance with art. 6, para. 1, clause 1, letter a GDPR,
  • Forwarding is required in accordance with art. 6, para. 1, clause 1, letter f GDPR for the exertion or defence of legal claims and there is no reason to assume that you have a predominant, proprietary interest in your data not being forwarded,
  • If forwarding is a statutory obligation in accordance with art. 6, para. 1, clause 1, letter c GDPR, or
  • it is permissible by law and required for the processing of contractual relationships with you in accordance with art. 6, para. 1, clause 1, letter b GDPR.

4. Cookies

We use cookies on our website. These are small files which are automatically created by your browser and stored on your device (laptop, tablet, smartphone or similar) when you visit our website. Cookies do not damage your device, they do not contain viruses, Trojans or other malware.

The cookie saves information relative to the specific device used. However, this does not mean that we can receive direct information about your identity.

One of the reasons for using cookies is to make using our services easier for you. For example, we use what are known as session cookies to see which individual pages of our website you have already visited. These are automatically deleted when you leave our website.

The data processed by the cookies is required for the above purposes and to preserve our justified interests and those of third parties in accordance with art. 6, para. 1, clause 1, letter f GDPR.

5. Analysis tools

The tracking measures listed below and used by us are carried out in accordance with art. 6, para. 1, clause 1, letter f GDPR. We use these tracking measures in order to guarantee that the website is designed in line with demand and continuously optimised. We also use the tracking measures in order to produce statistics about the use of our website and to evaluate our services to you in order to optimise them. These interests are considered justified in accordance with the regulations mentioned above.

Google Analytics

  • The website uses Google Analytics, an internet evaluation service from Google Inc. (“Google”). Google Analytics uses “cookies” (see 4.) that are saved on your computer and that facilitate the analysis of your use of this website. Google AdSense

  • This website uses the online advertising service Google AdSense, which allows you to be shown advertising targeted to your interests. The aim of this is to show you advertising that could be interesting to you in order to make the design of our website more attractive to you. This involves recording statistical information about you which is processed by our advertising partners. These adverts can be recognised by the “Google Ads” logo on the relevant advert.

Amazon partner programme

  • Geniatech Europe GmbH is a member of the partner programme operated by Amazon Europe S. à. R. l., and a partner in the advertising programme which was designed to provide a medium for websites by which advertising costs discounts could be earned through the placement of adverts and links to amazon.de. The aim of this programme is to show you advertising that could be interesting to you and to make our website more attractive for our users.
  • In order to show adverts, statistical information about you is recorded and processed by our advertising partners. When you visit our website, Amazon is given the information that you have accessed the relevant page of our website. Google Adwords Conversion Tracking

  • We use Google AdWords services in order to utilise advertising (known as Google AdWords) to draw attention to our attractive offers from external websites. We can use the data from the advertising campaigns to determine how successful individual advertising measures are. This allows us to show you advertising which is interesting to you, make our website more attractive for you and achieve a fair calculation of advertising costs.
  • This advertising is delivered by Google via what are known as “Ad Servers”. To do this, we use Ad Server cookies, which allow certain success measurement parameters to be measured, these include display of the adverts or clicks by the user. If you access our website via a Google advert, Google AdWords saves a cookie to your PC. As a rule, these cookies cease to be valid after 30 days and should not be able to identify you personally. Generally, this cookie contains analysis values such as the unique cookie ID, number of ad impressions per placement (frequency), last impression (relevant for post-view conversions) and opt-out information (notification that the user no longer wishes to be targeted).
  • These cookies allow Google to recognise your Internet browser again. When a user visits certain pages on the website of an AdWords customer and the cookie on their computer has not yet expired, Google and the customer can recognise that the user has clicked on the advert and been forwarded to this page. Every AdWords customer is assigned a different cookie. This means cookies cannot be traced via the websites of AdWords customers. Remarketing

As well as AdWords Conversion, we use the Google Remarketing application. This is a process by which we hope to appeal to you again. This application allows our advertising to be displayed to you as you continue to use the internet after visiting our website. This is based on cookies saved in your browser, through which Google records and evaluates your behaviour as you visit various websites. This means Google can see that you have previously visited our website. According to Google, it does not combine any data collected in line with Remarketing with any personal data which Google may hold about you. Google stresses that it uses a pseudonym-based process for remarketing.

 

DoubleClick by Google

  • This website also uses the DoubleClick by Google online marketing tool. DoubleClick uses cookies in order to display adverts which are relevant to the user, improve reports on campaign performance or prevent a user seeing the same adverts several times. Google uses a cookie ID to record which adverts have been displayed in which browser in order to prevent them being displayed multiple times. At the same time, DoubleClick can use cookie IDs to record what are known as conversions. These relate to advert enquiries. This is the case, for example, if a user sees a DoubleClick advert and then uses the same browser to access the advertiser’s website and buy something. According to Google, DoubleClick cookies do not contain personal information.

Facebook Custom Audiences

  • The website also uses the “Custom Audiences” remarketing function from Facebook Inc. (“Facebook”). This allows users of the website to be shown adverts related to their interests (“Facebook Ads”) when they visit the social network Facebook or other websites using the process. The aim of this is to show you advertising that is interesting to you in order to make the design of our website more attractive for you.
  • Based on the marketing tools used, your browser automatically establishes a direct connection to the Facebook server. We have no influence on the extent and the further processing of data collected by Facebook through the use of these tools and can therefore inform you based on our knowledge only: The use of Facebook Custom Audiences provides Facebook with the information that you have accessed the relevant parts of our website or clicked on one of our adverts. 6. Social media plug-ins

  1. We use the following social media plug-ins: Facebook, Google+, Twitter, LinkedIn. We use what is called the two-click solution. This means, if you visit our site, no personal data is initially passed on to the provider of the plug-in. You can recognise the providers of the plug-ins via their initial letters or logos on the respective boxes. By clicking on the button, you can communicate directly with the provider of the plug-in. Only if you click on the selected box and thereby activate it, will the plug-in provider be given the information that you have accessed the relevant page of our website. The data set out in section 2. a. of this policy is also transmitted. According to the providers themselves, Facebook and Xing automatically anonymise all IP addresses in Germany immediately after receiving them. Therefore, activating the plug-in sends personal data about you to the relevant plug-in provider, which then saves it (in the USA, in the case of American providers). As the plug-in providers primarily collect data via cookies, we recommend deleting all cookies via the security settings in your browser before clicking on the greyed-out box.
  2. We have no influence on the data collected for the data processing methods, nor are we aware of the full level of data collected, the purpose for collecting it and the period for which it is saved. We also have no information on the deletion of the data collected by the providers.
  3. The plug-in providers save the data collected about you in the form of usage profiles and use these for the purposes of advertising, market research and/or designing their websites to meet demand. This kind of evaluation primarily serves (even for users who are not logged in) to display demand-driven advertising and inform other users of the social network about your activities on our website. You have the right to object to the formation of these user profiles, but you will need to contact the respective plug-in provider to exert this right. The plug-ins give you the opportunity to interact with the social networks and other users, so that we can improve our services and make them more interesting for other users. The legal basis for the use of the plug-ins is article 6, para. 1, clause 1, letter f, GDPR.
  4. Data is passed on irrespective of whether you have an account with the plug-in provider and whether you are logged in. If you are logged in to the plug-in provider, the data collected from us is assigned directly to your existing account with the plug-in provider. If you press the activated button and, for example, link to the page, the plug-in provider also saves this information to your user account and shares it with your contacts in public. We recommend logging out on a regular basis after using a social network, but especially before activating the button, in order to avoid links to your profile with the plug-in provider.

7. AddThis bookmarking

  1. Our websites also contain AddThis plug-ins. This plug-in allows you to place bookmarks or share interesting content with other users. The plug-ins give you the opportunity to interact with the social networks and other users, so that we can improve our services and make them more interesting for other users. The legal basis for the use of the plug-ins is article 6, para. 1, clause 1, letter f, GDPR.
  2. Via this plug-in, your Internet browser establishes a direct connection to the AddThis servers and, where applicable, the selected social network or bookmarking service. The recipients are provided with the information that you have accessed on the relevant website or online service and the data set out in section 2. a. of this policy. This information is processed on the AddThis servers in the USA. We have concluded standard data protection clauses with AddThis.If you send content from our website to social networks or bookmarking services, a link can be established between the visit to our website and your user profile on the relevant network. We have no influence on the data collected for the data processing methods, nor are we aware of the full level of data collected, the purpose for collecting it and the period for which it is saved. We also have no information on the deletion of the data collected by the providers.
  3. The plug-in providers save this data in the form of usage profiles and use these for the purposes of advertising, market research and/or designing their websites to meet demand. This kind of evaluation primarily serves (even for users who are not logged in) to provide demand-driven advertising and inform other users of the social network about your activities on our website. You have the right to object to the formation of these user profiles, but you will need to contact the respective plug-in provider to exert this right.

10. reCAPTCHA

We use the reCAPTCHA service from Google Inc. (Google) in order to secure your enquiries made via the contact form. This differentiates whether the input has been made by a human or in an improper way by means of automated, machine processing. The enquiry includes sending the IP address and, where applicable, further information required by Google for the reCAPTCHA service to Google. Your input is transmitted to Google for this purpose and processed further. If IP anonymisation is activated on this website, your IP address is first truncated within member states of the European Union or other signatory states to the agreement on the European Economic Area. Only in exceptional circumstances is the full address sent to a Google server in the USA and then truncated. On behalf of the operator of this website, Google will use this information in order to evaluate your use of the service. The IP address transferred by your browser to reCAPTCHA is not amalgamated with any other Google data. This data is covered by the variant privacy policy from Google. If your personal data is processed on the basis of justified interests in accordance with art. 6, para. 1, clause 1, letter f GDPR, you have the right, In accordance with art. 21 GDPR, to submit an objection to the processing of your personal data, providing there are specific reasons relating to your personal situation or the objection is to direct advertising.
